Terms of Use

1. Acceptance of these Terms

These Terms of Use (“Terms”) govern your access to and use of theother80.io and any related pages and services (the “Site”) operated by The Other 80., Inc. (“The Other 80.” “we” “us” or “our”). By accessing or using the Site you agree to these Terms. If you do not agree, do not use the Site.

2. About the Site

The Other 80. is a live index and data visualization system tracking female-founded companies that are actively raising capital. The Site is provided for informational purposes only. Nothing on the Site is investment, legal, tax or financial advice, and nothing on the Site is an offer to sell or a solicitation of an offer to buy any security. Inclusion in the index is not an endorsement of any company or founder. You are solely responsible for your own investment decisions and due diligence.

3. Eligibility

You must be at least 18 years old to use the Site or submit information to the index.

4. Founder Submissions

When you submit information to the index (a “Submission”) you represent and warrant that:

  • you are submitting on your own behalf and the information is accurate and current;
  • you have the right to share the information you submit; and
  • your Submission does not violate any law or the rights of any third party.

Founder-submitted data is displayed publicly as part of a live index and visualization system. By submitting you explicitly consent to the public display of the fields marked as public on the submission form and to the aggregate use of your submitted information. You grant The Other 80. a non-exclusive, worldwide, royalty-free license to host, store, display, aggregate and analyze your Submission in connection with operating, improving and promoting the Site and our related services, including reports prepared for investors, allocators and limited partners.

We may review, verify, decline, edit for formatting or remove any Submission at our discretion. You may ask us to update or remove your Submission at any time by emailing hello@theother80.io. Aggregated or de-identified data that no longer identifies you may be retained.

5. Acceptable Use

You agree not to:

  • scrape, crawl, harvest or otherwise extract data from the Site by automated or manual means;
  • copy, reuse, republish, sell or redistribute data from the Site outside the Site;
  • submit false, misleading or impersonated information;
  • interfere with, disrupt or attempt to gain unauthorized access to the Site or its systems; or
  • use the Site for any unlawful purpose.

6. Intellectual Property

The Site and its content, design, compilations, visualizations, text, graphics and trademarks (other than Submissions and third-party marks) are owned by The Other 80. or its licensors and are protected by intellectual property laws. Except as permitted by these Terms, you may not use them without our prior written permission.

7. Third-Party Links and Partners

The Site may link to third-party websites and partner offers. We do not control and are not responsible for third-party sites, content, products or services, and your use of them is governed by their own terms and policies.

8. Disclaimers

The Site and all information on it are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. Information in the index is supplied by founders and may be incomplete, outdated or inaccurate. We do not warrant that the Site will be uninterrupted or error-free.

9. Limitation of Liability

To the fullest extent permitted by law, The Other 80. and its officers, directors, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising out of or related to your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars (US$100).

10. Indemnification

You agree to indemnify and hold harmless The Other 80. from any claims, losses and expenses (including reasonable attorneys’ fees) arising from your Submission, your use of the Site or your violation of these Terms.

11. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted, and the “Last updated” date above will change. Continued use of the Site after changes are posted means you accept the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.

Privacy Policy

This Privacy Policy explains how The Other 80., Inc. (“The Other 80.” “we” or “us”) collects, uses, shares and protects personal information when you use the Site or submit information to the index.

1. Information We Collect

Information you submit. When you submit to the index we collect:

  • Displayed publicly (fields marked + on the form): your name and title, company name and website, country and state or region, industry, stage, raise range and company and founder descriptors.
  • Kept private: your email address and LinkedIn profile. These are used to verify your Submission and to contact you. They are never published.

Information collected automatically. Like most websites, our hosting provider automatically logs basic technical information when you visit, such as IP address, browser type, device type, pages viewed and the date and time of your visit. We use this to operate, secure and improve the Site.

Communications. If you email us, we keep the content of your message and your contact details so we can respond.

2. How We Use Information

  • to display the public index and aggregate statistics and visualizations;
  • to verify Submissions and maintain the quality of the index;
  • to send you emails about your Submission, such as a confirmation and notice of inclusion in the index;
  • to prepare reports for investors, allocators and limited partners, which may include the public information about your company;
  • to operate, secure and improve the Site; and
  • to comply with legal obligations.

3. Legal Bases (EEA and UK)

If you are in the European Economic Area or the United Kingdom, we process your personal information based on your consent (public display of your Submission); our legitimate interests (verifying Submissions, operating and securing the Site and preparing investor reports) and compliance with legal obligations. You may withdraw consent at any time by contacting us.

4. How We Share Information

We do not sell your personal information. We share information only:

  • Publicly, for the fields you choose to make public through your Submission;
  • With investors, allocators and limited partners, in reports that include public company information;
  • With service providers that process data on our behalf, such as database hosting (Supabase), website hosting (Vercel) and email delivery (Mailchimp), under obligations to protect it; and
  • For legal reasons, when required by law or to protect the rights, property or safety of The Other 80., our users or others, or in connection with a merger, acquisition or sale of assets.

5. International Transfers

The Other 80. is based in the United States, and your information is stored and processed in the United States. If you submit from outside the United States, you understand that your information will be transferred to and processed in the United States, where data protection laws may differ from those in your country.

6. Data Retention

We keep your Submission for as long as it is part of the index or until you ask us to remove it. We keep other information only as long as needed for the purposes described in this policy or as required by law. Aggregated or de-identified data may be retained.

7. Security

We use reasonable technical and organizational measures to protect your information, including access controls that keep private fields such as email and LinkedIn from public view. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. Your Rights and Choices

You may ask us to access, correct, update or delete your personal information, or to remove your Submission from the index, at any time. Depending on where you live, you may also have the right to restrict or object to processing, to data portability, to withdraw consent and to lodge a complaint with your local data protection authority. Residents of certain U.S. states may have similar rights under state privacy laws. We will not discriminate against you for exercising your rights. To make a request, email hello@theother80.io.

9. Cookies

We use Google Analytics cookies to understand how visitors use the Site, such as which pages are viewed. These cookies are only set if you accept them in the cookie notice. We do not use advertising cookies. You can change your choice at any time by clearing cookies for this Site.

10. Children

The Site is not directed to anyone under 18, and we do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will delete it.
